Terms and conditions

AroundTown is a trade name of La Vita e Bella management, established in Rotterdam, registered with the Chamber of Commerce under number: 80384854 , General Terms and Conditions filed there.

1. General
1.1 Participants: Participant means every (legal) person who has made or wishes to make a reservation or booking with AroundTown and their representative(s), agent(s) and legal successor(s), as well as the person(s) for whom the booking has been arranged. The person who signs an AroundTown confirmation in the name of or on behalf of another person is liable for all obligations arising from the confirmation. In addition, all persons specified in the confirmation are each liable for their own part.
1.2 Activities: Activities include city walks, bus tours, boat trips, day packages, events and
workshops.

2. Applicability
2.1 These terms and conditions apply to all offers, quotations, proposals, confirmations and bookings.
2.2 The applicability of general terms and conditions of the customer is expressly rejected by us.
2.3 These conditions may be deviated from in writing.

3. Agreement
3.1 An agreement is established by signing the confirmation and returning it within 8 days.
3.2 Prices and reservations are valid until the option expiry date as stated in the offer. After the expiry date of the offer, there is no guarantee on the indicated prices.
3.3 AroundTown is entitled to refuse a reservation or booking without giving reasons.
3.4 Transport costs will be included in the quotation as a separate item and are not a standard part of the contract.

4. Payment
4.1 Within 7 days after the conclusion of the agreement, a down payment of 80% of the agreed price per group must be made.
4.2 AroundTown will send a total invoice of the entire booking with the confirmation. The total final amount must be paid no later than 7 days before the start of the booking.
4.3 In case of late payment, AroundTown is entitled to cancel the booked activity. Already paid amounts will not be refunded and the provisions in article 11 of these terms and conditions will then apply.
4.4 The invoice is considered approved if the participant has not responded within 8 working days after the invoice date; this also commits the client to pay the invoice.
4.5 If residual payments are not paid within the payment term stated on the invoice, AroundTown may charge 15% of the total price.
4.6 All communicated prices are in Euros and the VAT percentage is mentioned in the invoice.

5. Execution
5.1 AroundTown undertakes to execute the agreement to the best of its knowledge.
5.2 AroundTown commits to execute the activities within the agreed time programme, except for force majeure.
5.3 If a client arrives later than agreed at agreed time, the agreed end time will be kept.
5.4 If the end time is exceeded, additional costs will be charged.

6. Liability
6.1 AroundTown accepts no liability for damages resulting from death, injury, accidents, injury, loss or theft, caused to the participant(s) during or as a result of the activity, unless there is intent and/or gross negligence of (the employees of) AroundTown.
6.2 Participants are expected to use rented materials responsibly.
6.3 If after an activity it is established that damage has occurred to the rental equipment, this will fall under the liability of the renter. Costs arising from the repair are the responsibility of the lessee.
6.4 If rented materials are not returned, the new value will be charged.

7. Changes in activity program
7.1 AroundTown has the right to make changes in the program or cancel the program due to reasons related to AroundTown’s own business or third parties. AroundTown commits itself to notify the client immediately.
7.2 In case of a cancellation as mentioned above, AroundTown commits itself to immediately refund the full or partial payment. However, this only applies if AroundTown has not offered an equivalent programme for the group as a replacement.
7.3 The agreement can be changed by the customer. Reduction of the number of participants within a margin of 10% is only possible for individually booked restaurants, catering and scooter rental and not for tailor-made group arrangements. This reduction can be made free of charge up to eight working days before departure, before 4 pm.
7.4 If the number of participants is reduced by more than 10%, the cancellation provisions in Article 8 will be applied.
7.5 An increase in the number of participants must be notified in writing eight working days in advance. Always the full price will be charged. AroundTown cannot guarantee that these additional reservations are always possible.
7.6 For all changes above 25 persons the client will be charged €12,50 administration fee per group.

8. Cancellation and changes
8.1 Cancelling a package must be done in writing. The date of the postmark applies as the cancellation date.
8.2 In the event of a cancellation, the following amounts will be charged, unless otherwise agreed.
a. For cancellation up to one month before the day the activity takes place, €12.50 administration costs will be charged.
b. If cancelled up to 2 weeks before the day the activity takes place, 50% of the total price will be charged.
c. If cancelled within 2 weeks before the day the activity takes place, 75% of the package price will be charged.
d. If cancelled within 3 days before the day the activity takes place, 100% of the package price will be charged.
e. Changes in the number of participants up to a difference of 10% can be made free of charge up to 3 working days before departure. If the changes are made within 3 working days, the cancellation fee will be 100% of the package price. If the change in the number of participants exceeds 10%, AroundTown can be notified free of charge until two weeks before the day of the AroundTown activity. Within these two weeks the cancellation fee will be 100% of the package price.

9. Complaints
Despite all concerns, it is of course always possible that participants may have a justified complaint. This complaint should be submitted immediately to AroundTown, if possible on the day itself. If immediate submission is not possible, or if the complaint is not satisfactorily resolved, it should be submitted in writing to AroundTown no later than one week after. The regulations of these General Terms and Conditions will be applied.

10. General reservation AroundTown accepts no responsibility for photographs, leaflets and other information material, to the extent issued by third parties. These General Terms and Conditions have been filed at the Chamber of Commerce.

11. Participation in AroundTown programme
During an AroundTown programme, the organisation has the right to exclude participants from (part of) the activities if in its judgement physical, moral or mental abnormalities or conditions manifest themselves in such a way that the activity is (or threatens to be) hindered or prevented. The person concerned cannot claim an alternative programme. The person concerned is not entitled to a refund of the participation fee. This provision also applies in the event of misconduct.

12. Applicable law and disputes
12.1 In the event of a dispute about an agreement, both parties will try to resolve it by mutual agreement. If the dispute is not resolved, it will be submitted to the competent civil court in Rotterdam.
